Q&A: Employers: Prepare for PBM Reform
Question: We heard that a new law requires that employers make certain disclosures to participants & beneficiaries about our group health plan’s arrangement for pharmacy benefit management services. Is this true?
Answer: The Consolidated Appropriations Act, 2026 (CAA, 2026) contains detailed disclosure requirements that apply to contracts between group health plans or insurers & pharmacy benefit managers (PBMs) for plan years beginning on or after August 3, 2028.
- While provisions address disclosures from the PBM to the plan or insurer, there are elements that involve disclosures from the plan or insurer to participants and beneficiaries.
- Annual Notification. Participants and beneficiaries must be notified annually about the requirement that PBMs submit reports to the plan. This may be accomplished by incorporating the notification in to other plan documentation provided to participants and beneficiaries or by providing individual notification.
- Disclosures Upon Request. Among the materials required to be provided by the PBM to the plan or insurer is a summary appropriate for participants and beneficiaries, which the plan or insurer must furnish to a participant or beneficiary upon request. For a participant’s or beneficiary’s own claim, the plan or insurer must disclose, on request, the difference between the amount paid by the plan or insurer to the PBM (or other applicable entity) for the covered drug and the amount paid by the PBM (or other applicable entity) to the pharmacy for that drug.
Disclosure requirements will apply for plan years beginning on or after August 3, 2028; plan administrators should keep the requirements in mind for planning purposes, as revisions to service agreements & participant communications will be needed.
